NEXUS helps people cross between Canada and the United States quicker. This is a key benefit for frequent travellers. Pre-approved travellers save time and avoid long lines. Major airports offer NEXUS self-serve kiosks when entering Canada or the US. There is also faster clearance through land border crossings thanks to dedicated vehicle lanes. However, it can be difficult to apply with a criminal record. Here are some tips on how you can go about applying for the pass.

Will a criminal record get in the way of a NEXUS card?

A criminal record will likely hinder you from successfully applying for a NEXUS card. In order to apply, you will be interviewed by a Canadian Border Service Agency (CBSA) or US Center for Border Protection (CBP) officer. He or she will review your application, verify your identity and proof of citizenship or residency, ensure all eligibility criteria and scan for fingerprints. When determining if you will be granted a NEXUS Card, you may be questioned about your full criminal history. This will likely include arrests and Record Suspensions or pardons. Both Canada and the US must approve your application. If one of the countries deems you ineligible, your application will be denied. If you have been fingerprinted in the past, your application will likely be denied. A criminal record check will turn up any criminal activity regardless of whether you were found guilty or not.

What do I do next?

You should apply for a Canadian Record Suspension before applying for a NEXUS pass. However, the US doesn’t recognize Canadian Record Suspensions. They may still deem you ineligible for NEXUS. They may also flag you for the future. Instead, you can apply for a US entry waiver. However this waiver is not permanent and requires renewal. While it is not impossible to receive a NEXUS pass, you might consider foregoing the process. If you are flagged, it could complicate travelling.
