The U.S. Customs and Border Protection (CBP) agency is stringent with respect to the information which must be provided in support of an application for a US Entry Waiver.  For individuals with an existing criminal record related to an offence against the Controlled Drugs and Substances Act, applicants are required to provide verifiable evidence that there is no current abuse of controlled substances. The CBP requires either a copy of a drug screening test result or a letter from a Physician in support of their U.S. Entry Waiver application.

The CBP states, individuals applying for a U.S. Entry Waiver with a narcotics conviction “will need to provide evidence of treatment/rehabilitation. Such evidence shall include, but may not be limited to, the following: A recent drug test; credible, verifiable evidence related to rehabilitative history; statement from the applicant making clear his/her commitment to refrain from using controlled substances in the United States; credible, verifiable evidence outlining subject’s program for substitution therapy/treatment and/or continued care relative to his/her drug use/addiction if allowed to enter the United States.” http://www.cbp.gov/travel/international-visitors/admission-forms

It is the responsibility of the individual to provide the required results of a drug screening test or to provide other documentation to support their U.S. Entry Waiver application. For additional information related to Pardon Services Canada offerings, please contact us.
