The pardon requirements in Canada are pretty simple. As well, there are many benefits to obtaining a Canadian pardon. Therefore, if you are qualified, you should apply.
Have you ever been convicted of a criminal offence? Your record will follow you throughout life, unless you obtain a pardon. You may have to overcome barrier after barrier. For example, a record can impede travel, career goals, and volunteering. A Record Suspension (pardon) is the only way to overcome these obstacles. Before you apply, there are some pardon requirements in Canada. The Parole Board of Canada will not consider your request until you fulfil court orders and complete the waiting period. Here’s how to move toward a Record Suspension in Canada.
Pay all outstanding fines and restitution
You can only request a Record Suspension once you have fully paid off all fines and fees. Failing to do so can result in a breach of probation order. It could increase the balance owing.
Serve sentences
You must serve all of the sentence before you become eligible. This could include jail, rehab, house arrest or community service. Official release from jail by statutory release or parole count as completing your sentence in full.
Finish probation
You must complete probation before you apply. Probation requires you to avoid criminal activity and display good behaviour. You may also need to complete counselling, avoid carrying weapons, and abstain from drugs and alcohol while on probation. If you defy your probation orders, they could be extended.
Fulfil pardon requirements for waiting periods
You must fulfil the waiting period before applying. The pardon requirements waiting period only begins after you serve your sentence. This includes probation, fines and fees. It does not include weapons or driving bans. In 2013, the government extended the period from three years to five years for summary convictions. If you have an indictable conviction, you need to wait 10 years. People with more than three serious convictions, or just one involving sex crimes against juveniles, are not eligible.
When you receive your pardon, you can move forward with your life without worry. A Record Suspension acknowledges your rehabilitation. If you are ready to get started, contact us today at 1-866-972-7366.
Why are US companies not forced to follow Canadian background check rules? They employ Canadians in Canada and use US records which still show my record. Just because it was suspended in Canada does not mean US companies honour the suspension. Why?
Hi Kelly,
Yes, you are right. It’s not fair that Canadians have to continue to apply to enter the US even after receiving a Record Suspension. I guess it’s just because the US is not bound by Canadian laws. If it’s any consolation, the Canadian government doesn’t consider US pardons either. People with convictions in the US also have to apply for a permit to enter Canada even if they were pardoned. Perhaps you could write to your local Member of Parliament requesting that they ask the government to reconsider this and come to some agreement with the US government.
